Terms and Conditions
1. Introduction
1.1 These Terms apply when you, as a customer, buy any product or service from Kolonati Construction South Africa either in-store or online, and they constitute a valid and binding agreement between you and Kolonati Construction South Africa.
1.2 By using our premises or website, or by purchasing any of our products or services, you agree to comply with these Terms and Conditions without modification.
1.3 By using the website or purchasing goods or services from us, it will be presumed that you have read, understood, and agreed to these Terms and Conditions.

2. Definitions
2.1 CPA means the Consumer Protection Act, 2008.
2.2 ECT Act means the Electronic Communications and Transactions Act, 2002.
2.3 Lay-by has the meaning set out in clause 10.
2.4 Kolonati Construction South Africa means Kolonati Construction (Pty) Ltd.
2.5 Premises means any premises used by Kolonati Construction South Africa to conduct its business.
2.6 Privacy Policy means the Kolonati Construction Privacy Policy, as amended from time to time.
2.7 Product means any product sold by Kolonati Construction South Africa either in-store or on our website.
2.8 Service means any service you purchase from us, either rendered by Kolonati Construction directly or by third parties.
2.9 Special Orders means any product or service created, personalised, or procured specifically to meet your requirements.
2.10 Store means any Kolonati Construction store within South Africa.
2.11 Terms means these general terms and conditions, which may be amended from time to time.
2.12 Us/We means Kolonati Construction South Africa.
2.13 You means the customer of Kolonati Construction South Africa.
2.14 Website means www.kolonaticonstructions.co.za.

Where the CPA applies to you as a consumer, certain terms that limit your rights, impose obligations, or require you to confirm certain facts are highlighted in bold to draw your attention to them. These clauses are important and should be read carefully.
3. Personal Information
3.1 During your interaction with Kolonati Construction South Africa, we may collect and process your personal information as defined under the Protection of Personal Information Act, 2013 (POPIA). Submission of this information may be necessary to purchase goods, use services, or access the website.

4. Products and Services
4.1 We make every effort to ensure the accuracy of information about our products, whether displayed in-store, online, or in promotional material.
4.2 While we strive for accuracy, actual products may vary slightly from images or descriptions due to changes in packaging or display differences.
4.3 In the event of an obvious error in a product description, price, or image, we reserve the right not to supply the product and will correct the error promptly.
4.4 It is your responsibility to ensure you have received the correct product. If you receive an incorrect item, you must notify us within 10 business days to correct the error. You may cancel the transaction and receive a refund within this period.
4.5 If you are not satisfied with a product, you may return it subject to our returns and refund policy.
4.6 Some services are provided by third parties. We may invoice you directly but will not be liable for third-party service obligations. Claims must be made directly to the service provider.
4.7 If you are not satisfied with services provided directly by us, please contact us and we will do our best to resolve the issue.
4.8 We reserve the right to discontinue or amend our product and service offerings without notice.
5. Pricing and Availability
5.1 Product availability is subject to stock.
5.2 Prices displayed in-store, online, and in promotional material are correct unless an obvious and inadvertent error occurs.
5.3 We may limit the quantity of products during promotions, with such limitations clearly stated.
5.4 All prices are quoted in South African Rands and are valid only within South Africa.
5.5 All prices include VAT.
5.6 Displayed prices may change; however, you will be charged the price at the time of your order unless an obvious error has occurred.
5.7 Any corrections to errors will be displayed at the entrance of each store.
5.8 Products are only reserved once a 50% deposit has been paid, a lay-by agreement has been entered into, or where products are required for installation or delivery services.
6. Payment
6.1 Products and services must be paid for in full before delivery.
6.2 In-store payments can be made via cash, credit/debit card, or Kolonati Construction Gift Card.
6.3 Online purchases must be paid by credit card, EFT, or through one of our online payment platforms. EFT payments may take up to 7 business days to reflect before processing.
7. Special Orders
7.1 Special orders must be paid in full before processing.
7.2 If you cancel a special order after work has commenced, a cancellation fee of up to 100% of the deposit may apply. If we cancel the order, you will receive a full refund.
8. Website Purchases
8.1 To place an order online, you must create a user profile.
8.2 Registration requires personal information, payment details, and a delivery address. You must choose a secure password.
8.3 If someone else uses your account without permission, notify us within 24 hours.
8.4 You must enter your login details each time you visit our online store.
8.5 By placing an order, you:

Confirm you are over 18 years of age and legally capable of entering into a contract;

Consent to us sharing your information with third parties (banks, couriers) only as necessary;

Authorize us to verify your order details to prevent fraud.
8.6 Your sale contract is complete once we accept and dispatch your order.
8.7 Products are only available for delivery within South Africa.
9. Collection and Delivery
9.1 Orders are delivered only after full payment is received.
9.2 Deliveries are restricted to South Africa. Delivery charges are based on location, size, quantity, and weight.
9.3 Delivery times are estimates and may vary due to third-party couriers.
9.4 You are responsible for providing the correct delivery address.
9.5 Full risk passes to you at the point of delivery. We are not responsible for storage, assembly, or installation unless agreed.
9.6 Notify us within 24 hours of any missing or damaged products.
9.7 Partial collections are not permitted; full orders must be collected.
9.8 It is your responsibility to ensure your vehicle can safely transport your full order.
9.9 We may refuse to load your vehicle if we believe there is a safety risk.
9.10 Orders must be collected within 30 calendar days after notification. Failure to collect within 14 working days may result in cancellation without refund.
10. Lay-by
As of January 2025, Kolonati Construction South Africa will no longer offer lay-by options.
We have partnered with reputable financial institutions to offer “buy now, pay later” solutions online.
Existing lay-by agreements will continue, but no new lay-bys will be initiated from January 2025.
